These Terms and Conditions govern access to the Elyx website, dashboard, APIs, communications, and related services operated by Preplink Limited. By accessing or using Elyx, you agree to these terms on behalf of yourself or the business you represent.

If you are accepting these terms for a company or organisation, you confirm that you have authority to bind that organisation.

Elyx provides software and AI-assisted tools for answering calls, handling enquiries, creating bookings, sending messages, supporting payment flows, surfacing tasks, and coordinating operational workflows.

Specific features, limits, and usage allowances depend on the plan, integrations, and configuration selected for your account.

You are responsible for keeping account credentials secure, limiting access appropriately, and making sure all information you provide is accurate and up to date.

• You must not share credentials in a way that bypasses seat, user, or permission controls.
• You remain responsible for actions taken through your account unless caused by our breach of security obligations.
• We may suspend or restrict access if we detect misuse, fraud, security risks, or material breaches of these terms.

You may not use Elyx in a way that is unlawful, deceptive, abusive, or technically harmful.

• Do not use Elyx to violate applicable telecoms, privacy, consumer, payments, or marketing laws.
• Do not impersonate people, misrepresent identity, or use the platform for fraud or harassment.
• Do not attempt to reverse engineer, disrupt, probe, overload, or bypass service protections except where the law explicitly permits that right and it cannot be waived.
• Do not upload or connect data unless you have the right to use it for the purposes configured in Elyx.

You are responsible for the instructions, business rules, caller disclosures, integrations, and data sources you configure in Elyx. You are also responsible for making sure your use of the service matches the requirements of your industry and jurisdiction.

That includes call recording disclosures, appointment and deposit policies, refund obligations, and any notices required for SMS, email, or payment collection.

Paid plans are billed according to the pricing and billing cycle you select, plus any applicable taxes unless stated otherwise. Subscriptions renew automatically until cancelled.

If payment cannot be collected, we may retry payment, downgrade access, suspend parts of the service, or pause the account until billing is brought up to date.

We may offer trials, onboarding promotions, or custom commercial terms. Unless stated otherwise, trials convert to paid service at the end of the trial period if you have not cancelled in time.

You can cancel future renewals, but fees already paid are generally non-refundable except where required by law or expressly agreed in writing.

You retain rights to the business data and content you provide. You grant us the rights needed to host, process, transmit, and use that content to operate, secure, and improve Elyx for your account.

We retain all rights in Elyx, including the software, models, design, documentation, workflows, branding, and service improvements, except for rights expressly granted to you in these terms.

We aim to keep Elyx available and reliable, but we do not promise uninterrupted or error-free service. We may update, modify, replace, or discontinue features from time to time.

Where practical, we will try to give reasonable notice for material changes that affect paid usage or core functionality.

To the maximum extent permitted by law, Elyx is provided on an as-available basis and we exclude indirect, incidental, special, consequential, and punitive losses, including lost profits, lost revenue, lost data, or loss of goodwill.

Our aggregate liability for claims arising out of or related to Elyx will not exceed the fees paid by you to us for the service during the 12 months before the event giving rise to the claim.

You may stop using the service at any time. We may suspend or terminate access if you materially breach these terms, fail to pay fees, create security risk, or use the platform unlawfully.

On termination, your right to use Elyx ends immediately, but sections that by nature should survive will continue, including billing obligations, limitations of liability, and IP protections.

These terms are governed by the laws of Ireland. Unless applicable law requires otherwise, the courts of Ireland will have exclusive jurisdiction over disputes arising out of or connected with Elyx.
